====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-12-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner seeks bail in a case registered for the offence punishable under Section 140(3) of the B.N.S., 2023, and later Section 103(1) of the B.N.S., 2023 was added.
3. As per the prosecution case, the informant alleged that on 04.04.2025, the younger brother of the informant went missing. The F.I.R. was registered against unknown persons.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. During investigation, the name of the petitioner surfaced on the basis of the confessional statement of Shiva Giri. Except for the confessional statement, there is no material to indicate complicity of the petitioner.

5. Learned A.P.P. for the State vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the nature of accusation and the period of custody, the prayer for grant of bail to the petitioner is allowed.
7. Accordingly, let the above-named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Saran at Chapra, in connection with Panapur P.S.
