JUSTICE SHIVAJI PANDEY ORAL ORDER 25-08-2020 Heard learned counsel for the petitioner and learned counsel for the State as well as learned counsel for the informant through virtual court proceeding.

In this present case, the petitioner is seeking bail in connection with Sadar P.S. Case No. 423 of 2018 registered for offence punishable under Sections 302, 201 and 120 (B)/34 of the Indian Penal Code.

Allegation against the co-accused including the petitioner is to have killed the father-in-law of the informant, namely, Mahesh Jha on account of land dispute, however, counsel for the petitioner submits that there is no material in the case diary to suggest the involvement of the petitioner and merely on suspicion, he has been implicated in the present case.

Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 423 of 2018 with a condition that the petitioner will appear before the court below on each and every date and if he fails to appear on two consecutive dates without sufficient reason, the court below will be at liberty to cancell his bail bonds and he will be taken into custody forthwith.
