The petitioner seeks bail in anticipation of his arrest in connection with Bhabua P.S. Case No. 692 of 2018 dated 03.10.2018 instituted for the offences under Sections 341, 323, 504, 506, 379 and 307 of the Indian Penal Code.

The informant has alleged that while he was sitting at his shop, about 10 persons came and brutally assaulted him. He could identify only the petitioner from amongst the miscreants.

Learned counsel appearing for the petitioner has submitted that because of a dispute over return of Rs. 50,000/- which was given as an accommodation loan to the informant, the present case has been lodged.

Patna High Court Cr.Misc. No.79933 of 2018(2) dt.17-01-2019 2/2 Be that as it may, there is no injury report on record and the informant does not wish to prosecute the petitioner any further. The aforesaid facts get reflected from the impugned order.

Considering the aforestated facts as also taking into account that the petitioner has no criminal antecedents, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 692 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
