2. The petitioner seeks bail in connection with Korha P.S. Case No. 327 of 2021 instituted for the offences punishable under Sections 341, 323, 379, 385, 327 and 506/34 of the Indian Penal Code.

3. As per allegation in the FIR, all the named accused persons including the petitioner along with 10-15 unknown persons attacked by means of arrow, snatched Rs. 5,000/-, looted two lakhs rupees and demanded Rangdari of Rs. 5,00,000/- from the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that petitioner

He further submits that the present FIR has been lodged against three accused persons and 10-15 unknown persons alleging general and omnibus allegation of assault and attempt to murder by means of arrow upon the informant and his driver. He next submits that the whole prosecution case is based on land dispute. He lastly submits that similarly situated coaccused person has already been granted bail by the trial Court as submitted by learned counsel for the petitioner. Petitioner is in custody since 23.07.2023.

5. Learned APP for the State opposes the prayer for bail.

6. From perusal of the FIR and impugned order of the learned Additional Sessions Judge-II, Katihar dated 17.09.2025, it appears that petitioner is named in the FIR. From perusal of the records, it appears that on the basis of written report of the informant Narayan Kumar Jha, FIR has been registered under Sections 341, 323, 379, 385, 327 and 506/34 of the Indian Penal Code against three named and 10-15 unknown persons including the present petitioner and the allegation is of attacking by means of arrow, snatched Rs. 5,000/-, looted two lakhs rupees and demanded Rangdari of Rs. 5,00,000/- from the

No.74194 of 2025(2) dt.19-11-2025 3/3 informant and similarly situated co-accused person has already been granted bail by the trial Court as submitted by learned counsel for the petitioner, so considering all these aspects of the case and submissions of learned counsel for the petitioner, I am inclined to grant bail to the petitioner.

7. Accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Korha P.S. Case No. 327 of 2021.
