Petitioners apprehend their arrest in Sabour P.S. Case No.202 of 2018 registered under Sections 406, 419, 420, 341, 323 and 506/34 of the Indian Penal Code.
The informant alleged that he entered into an oral agreement with Naresh Yadav for purchasing a piece of land on consideration of Rs.22 lacs. The informant advanced Rs.5,21,000/- to Naresh Yadav through cheques but later on Naresh Yadav refused to execute the sale deed. It is further alleged that when the informant went to demand money, Naresh Yadav and his three sons, who are petitioners, assaulted him. Learned counsel for the petitioners submits that the petitioners did not enter into agreement with the informant.

No.80035 of 2018(2) dt.11-01-2019 2/2 Petitioners never received any money but petitioners have falsely been implicated only because their father received money from the informant to execute the sale deed. Having considered the facts aforesaid and the nature of allegation made against the petitioners, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Bhagalpur in connection with Sabour P.S.
