1. Heard learned counsel for the petitioner and the learned APP for the State.
2. Petitioner seeks regular bail in connection with Mehandiganj P.S. Case No. 121 of 2022 dated 14.08.2022 registered for the offence(s) punishable under Section(s) 30(a) of Bihar Prohibition and Excise Act.
3. The main submissions advanced by the learned counsel for the petitioner are that the alleged country made liquor was not recovered either from petitioner's house or from his conscious possession, in fact the same was recovered from a thatched house (bamboo hut) which does not belong to the petitioner, who has not been arrested at the spot and he was remanded in this case on 14.11.2022 merely on the basis of
Patna High Court CR. MISC. No.75288 of 2022(2) dt.25-04-2023 2/2 suspicion, though against the petitioner, there are criminal antecedents of five case but he is on bail in four cases.
4. Learned APP appearing for the State has opposed the bail prayer.
5. Considering the above submissions, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail in connection with Mehandiganj P.S. Case No. 121 of 2022 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Court concerned.
