The petitioner apprehends his arrest in connection with Manigachhi (Nehra O.P) P.S. Case no. 140 of 2019, registered under Sections 147, 149, 341, 323, 353, 504 and 506 of the Indian Penal Code.

The accusation is that informant and other Police personnel received information about selling and preparing of illicit liquor by Satan Sahni at village Jagdishpur, the informant and other Police personnel reached there and raided the house of Satan Sahni, while liquor was not found, but Jaba Mahua kept in water and 50 to 60 empty tin recovered from the house of petitioner, while Jaba Mahua was damaged. Thereafter, an inquiry was made by Satan Sahni, but his family members

Patna High Court CR. MISC. No.66027 of 2019(2) dt.05-11-2019 2/2 came there and started scuffle then Satan Sahni succeeded to flee away.

Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner was not apprehended on the spot and only Jaba Mahua is said to be recovered, which was damaged by the informant and other Police personnel. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-V, Darbhanga in connection with Manigachhi (Nehra O.P) P.S. Case No. 140 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
