The petitioner is in custody since 03.09.2019 in connection with Baikunthpur P.S. Case No. 290/18 registered for the offence punishable under Sections 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the Bolero vehicle. It is further submitted that the petitioner is having three criminal antecedents, in one case, he has been acquitted and in other two he has been on bail.

In view of the aforementioned facts and circumstances, let the petitioner above named be released on

Patna High Court CR. MISC. No.66620 of 2019(2) dt.24-10-2019 2/2 bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge II cum Special Judge Excise, Gopalganj, in connection with Baikunthpur P.S. Case No. 290/18.
