This application for anticipatory bail, arises out of Deoriya Police Station Case No. 90 of 2017, disclosing offences punishable under Sections 399, 402, 414, 34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner has submitted that he has been implicated only on the basis of statement of coaccused apprehended by the police at the place of occurrence. He contends that over and above the same, there is no material against this petitioner. He also submits that the petitioner has no criminal antecedent.

However, considering the seriousness of allegation

Patna High Court Cr.Misc. No.80301 of 2018(2) dt.24-01-2019 2/2 and nature of offence, I am not inclined to grant this petitioner privilege of anticipatory bail.

This application is, accordingly, dismissed.

The petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit, without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
