JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2019 The petitioner apprehends his arrest in connection with Barahara (Khawaspur) P.S.Case No. 315 of 2018 registered under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation as per the FIR is that police intercepted three motorcycles and two accused persons were arrested and other succeeded in fleeing away . The arrested accused persons has named the petitioner and other co-accused and there is recovery of 144.900 litres of English wine.

Submission of learned counsel for the petitioner is that nothing has been recovered from the possession of the petitioner and he has been named by co-accused and has no criminal antecedent.

No.77903 of 2018(2) dt.03-01-2019 2/2 Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Addl. Sessions Judge-cum-Special Judge, Excise Bhojpur at Ara in connection with Barahara (Khawaspur) P.S. Case No. 315 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
