The petitioner seeks bail in connection with Pakribarawan P.S. Case No. 64 of 2019, registered for the offence punishable under Sections 379 and 420 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the FIR, however he has falsely been implicated in the present case merely on suspicion. Further submission is that there is delay of 10 days in lodging FIR without plausible explanation. He further submits that during investigation no material has come against the petitioner except that fact as mentioned in para 19 of the case diary that this petitioner was seen near the ATM in question a
Patna High Court CR. MISC. No.65994 of 2019(2) dt.13-11-2019 2/2 few days before. The petitioner is in custody since 31.05.2019. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Nawada in connection with Pakribarawan P.S. Case No. 64 of 2019.
