JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 Petitioners apprehend their arrest in connection with Kutumba P.S. Case No. 50 of 2018 registered for the offences punishable under Sections 498A of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

Allegation against the petitioners, who are father-inlaw, mother-in-law and brother-in-law of the informant, is of subjecting the informant to cruelty with respect to demand of dowry.

Submission of learned counsel for the petitioners is that they are in-laws and no specific allegation has been attributed against them and whole family members have been made accused in this case.

Having heard both sides and in the facts and circumstances, let petitioners, above named, in the event of arrest or surrender within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Kutumba P.S. Case No. 66 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further condition that one of the bailors of the petitioners shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
