JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 This is an application for grant of anticipatory bail in connection with Hajipur Town P. S. Case No. 390 of 2018, disclosing offences under Sections 304/34 of IPC. As per F.I.R. the son of the informant met with an accident and he was taken to Vaishali Clinic for his treatment and he was operated by the petitioner showing himself as a Doctor. Later on, his condition deteriorated and he was taken to other hospital, where he died. It further appears that several parts of the body was removed from his body.
Submission of the learned counsel for the petitioner is that he has not operated the son of the informant, rather it has been operated by Reshma Kumari and she has been granted privilege of anticipatory bail by the learned court below itself. Heard learned A.P.P. also.
Patna High Court CR. MISC. No.71526 of 2019(3) dt.27-11-2019 2/2 Having heard both sides, in view of the allegations, especially without having any degree, he operated the injured, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, he has to surrender before the learned court below and make prayer for regular bail, the same shall be considered on its own merit.
