2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352, 303(2) and 3(5) of the B.N.S., 2023.
3. As per prosecution case, the informant namely, Suresh Singh alleged that on 02.06.2025 at around 07:00 PM, the named co-accused persons armed with lathi, danda and rod came at the house of the informant and abused him and on his protest, all of them assaulted him. It is further alleged that co-accused Raju Singh assaulted the informant with iron-rod repeatedly and when his wife and son came to his rescue, they were also assaulted by the co-accused persons.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is no allegation of any assault or overt act
Patna High Court CR. MISC. No.72284 of 2025(2) dt.15-10-2025 2/2 attributed against the petitioner, rather the allegation levelled against the petitioner are general and omnibus in nature and the specific allegation of assault is attributed against the co-accused Raju Singh. He lastly submits that petitioner claims clean antecedent.
5. Learned APP for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case and also considering the fact that there is no specific allegation of any assault levelled against the petitioner and petitioner has clean antecedent, let the petitioner, above-named, in the event of his arrest / surrender before the learned trial Court within a period of eight weeks from today, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st , Saran, in connection with Dighwara P.S. Case No. 203 of 2025, subject to the condition as laid down under Section 438(2) of the Cr.P.C. / Section 482(2) of the B.N.S.S., 2023.
