Petitioners apprehend their arrest in connection with Ramgarhwa P.S. Case No.233 of 2022, registered for the offences punishable under Sections 341, 323, 324, 325, 307, 354, 379, 504 and 34 of the Indian Penal Code.

As per averment of the FIR, named accused persons including the petitioners in furtherance of common intention were constructing hut in the land of the informant and when the informant objected, the accused persons assaulted the informant and her family members. There is further allegation that the

Patna High Court CR. MISC. No.75231 of 2022(2) dt.07-02-2023 2/2 accused persons tried to outrage the modesty of the informant and they took away box from her house containing cash Rs.40,000/-, ornament and documents.

Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. The petitioners have got no criminal antecedent as stated in paragraph-3 of the bail petition. It is further submitted that there is case and counter case between the parties and both sides sustained injuries. It is submitted that the injuries were found simple in nature which is clear from the impugned order itself. Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Raxaul at Motihari, District East Champaran in connection with Ramgarhwa P.S.
