2. Earlier the bail application of the petitioner was rejected by this Court vide order dated 07.11.2023 in Cr. Misc. No.71495 of 2023, which reads as follows:- Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in connection with Murliganj P.S. Case No.43 127 of 2023, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner has killed the brother of the informant.

4. Since the petitioner is the assailant of the deceased, I am not inclined to grant bail to the petitioner.

5. Accordingly, this application stands dismissed.

6. The Court below is directed to expedite the trial.

3. Though the trial has not proceeded as it should but considering the fact that the petitioner is the assailant, I am not inclined to grant bail to the petitioner.

4. Accordingly, this application is dismissed.

5. The Trial Court is directed to expedite the trial of the petitioner. The petitioner is at liberty to renew his prayer for bail if the trial is delayed by the prosecution. (Sandeep Kumar, J) shikha/- U T
