JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 This application, for grant of anticipatory bail, arises out of Vaishali Excise Case No. C2A-121/2018, disclosing offences under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016.

Allegation is of recovery of 1048.320 liters from a room near the garage of the petitioner .

Submission of learned counsel for the petitioner is that the place from which, the recovery has been made, does not belong to the petitioner and recovery of 198 litres of liquor and other accused persons have already been granted the privilege of anticipatory bail.

Having heard both sides, considering the fact that huge

Patna High Court Cr.Misc. No.2049 of 2019(2) dt.16-01-2019 2/2 quantity of liquor has been recovered from the garage of the petitioner, I am not inclined to grant the privilege of anticipatory bail to him rather petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order, if possible on same day.
