====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 16-01-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are seeking anticipatory bail in connection with Bettiah Town P.S. Case No. 663/2018 registered under Sections 387 of the Indian Penal Code, pending in the court of learned C.J.M., Bettiah, West Champaran. Learned counsel for the petitioners submits that on perusal of the first information report as well as the impugned order of the learned Sessions Judge, Bettiah, West Champaran, it would appear that the main allegations are against one Ravi Kumar @ Pinnu. So far as these petitioners are concerned, they have been falsely implicated in this case without there being any material against them.
Learned Additional Public Prosecutor for the State is
Patna High Court Cr.Misc. No.2075 of 2019(2) dt.16-01-2019 2/2 present and opposes the prayer for anticipatory bail of the petitioners.
In the facts and circumstances of the case where it appears from reading of the F.I.R. that the telephone call was made allegedly by one Ravi Kumar @ Pinnu who had abused the brother of the informant, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No. 663 of 2018, subject to condition that petitioners shall join investigation by reporting to the Investigating Officer within a period of three weeks from today and shall cooperate in course of investigation, failing which the Investigating Officer shall be at liberty to take steps for cancellation of bail. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
