JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Phulwari Sharif P.S. Case No. 782 of 2019 registered for the offences punishable under Sections 304B and 120B of the Indian Penal Code.

Petitioner happens to be husband of deceased and there is allegation that he demanded Rs.10 lac for starting a business and for that he tortured her and caused her death. Submission of learned counsel for the petitioner is that she has committed suicide and she was taken to hospital and information about the same has also been given to the informant's side and moreover petitioner is working at Nagpur and he was at that time was at Nagpur.

Heard learned APP, who has opposed the prayer for anticipatory bail there is allegation against the petitioner and the

Patna High Court CR. MISC. No.69558 of 2019(2) dt.06-11-2019 2/2 case is under Section 304B IPC.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner. However, if petitioner surrenders and prays for regular bail, the same shall be considered on the basis of the materials available during investigation and, if possible, to be disposed of on the same day.

This application is, accordingly, dismissed.
