The petitioner seeks bail in connection with Bihariganj P.S. Case No.267 of 2022 registered for the offence punishable under Section 302, 120-B/34 of the Indian Penal Code.

The petitioner and others are said to have killed the son of the informant. The petitioner is in custody since 13.07.2023.

Learned counsel for the petitioner has drawn the attention of this Court to an order dated 28.07.2023 passed in Criminal Miscellaneous No.25687 of 2023 by which similarly co-accused Totaram Kamti has been granted bail by a coordinate Bench of this Court.

Considering the fact that similarly situated co-accused has been granted bail by a coordinate Bench of this Court and also the fact that the petitioner has clean antecedent, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Udakishunganj, Madhepura, in connection with Bihariganj P.S. Case No.267 of 2022.
