JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2019 This application, for grant of anticipatory bail, arises out of Balia P.S. Case No. 69/18, disclosing offences under Sections 302/34 of the Indian Penal code.

Allegation against the petitioners and others is of assault to the deceased causing his death.

Submission of learned counsel for the petitioners is that only three injuries has been found on the dead body of the deceased, whereas, it is alleged that seven named persons and four unnamed accused persons have participated in the occurrence and considering the same, some of the co-accused persons have already been granted the privilege of anticipatory bail by this Court vide order dated 03.08.2018 passed in Cr. Misc. No. 45421 of 2018.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Presiding Officer, Fast Track Court No. - I, Begusarai, in connection with Balia P.S. Case No. 69/18, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
