2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 408, 409, 420/34 of the Indian Penal Code.

3. As per the prosecution case, petitioner, being Branch manager in league with the branch employees, misappropriated a total of Rs.15,29,662/- of Micro finance Company which was engaged in poverty alleviation programme by providing micro loans to poor women and when this offence was detected, petitioner and other accused persons fled away from the branch of the Company.

4. Learned counsel appearing for the petitioner submits that the F.I.R. has been lodged after inordinate delay of seven months without any explanation which renders the entire prosecution case doubtful. Petitioner was seriously ill during the intervening period of June, 2023 to November, 2023 in

Patna High Court CR. MISC. No.83659 of 2024(4) dt.10-02-2025 2/2 which his senior was in-charge of the branch, thus, petitioner has not defalcated any amount. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the prayer for bail. He submits that there is direct allegation that petitioner, being Branch manager, in league with the branch employees, misappropriated a total of Rs.15,29,662/- of Micro finance Company.

6. Considering the nature and gravity of allegation, prayer for bail of the petitioner is rejected. (Prabhat Kumar Singh, J) shashi/- U T
