The petitioner apprehends his arrest in connection with Barharia P.S. Case No. 115 of 2021 registered under Section 272/273 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to dirty village politics and land dispute. Further he submits that from perusal of the seizure list, it is apparent that the alleged illicit liquor has been recovered near the Western side of canal. Petitioner has no criminal antecedent.

Having considered the facts and circumstances of the

No.5025 of 2023(3) dt.19-05-2023 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the A.D.J.-II-cum-Special Judge, Excise, Siwan in connection with Barharia P.S. Case No. 115 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
