Petitioner seeks bail in a case registered under Sections 498A, 328, 102B and 304B of Indian Penal Code. Petitioner, who is the husband of the victim, is in custody in this case since 10.04.2017. He has no prior antecedent. It is submitted that the material collected during the course of investigation shows that the victim was not in full sense. The informant has also filed a petition before the Chief Judicial Magistrate, Supaul which has been brought on record by Annexure 2 to the instant petition wherein he has stated that, under misconception, he has lodged this first information report and that he does not have any issue against the petitioner.

Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in Supaul Police Station Case No 536 of 2015 subject to the following conditions:
(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.
(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
