2. The petitioner is in custody in connection with S.Tr. No. 123/2021, CIS S.Tr. No. 101/2021 arising out of Shikarpur P.S. Case No. 167 of 2020 for the offence registered under Section 302, 307, 354, 341, 323, 324, 504 and 34 of the Indian Penal Code, lodged on 15.04.2020 by the informant Fulsohban Khatoon.
3. As per the prosecution story, the informant alleged that the accused persons armed variously came and the petitioner assaulted by iron rod on his head, the son was also assaulted and they were taken to the hospital where the son was
Patna High Court CR. MISC. No.77645 of 2024(3) dt.17-03-2025 2/2 declared dead. Accordingly, the F.I.R.
4. Learned Senior Counsel submits that there is a case and counter case, the petitioner remained in custody for long (since 22.03.2023) and the trial has still not been concluded despite the earlier rejection on 05.09.2023.
5. Earlier, a report was called for in this case on 29.01.2025 which has come according to which seven out of twelve witnesses have been examined and the next date of hearing was 07.02.2025. The letter is dated 05.02.2025.
6. Considering the aforesaid facts that more than half of the witnesses have been examined and there is direct allegation against this petitioner, directing the Trial Court to conclude the trial within a period of next six months, the bail application stands rejected.
