The petitioner seeks bail in K. Nagar (Srinagar) P.S. Case No. 483 of 2017 registered under Section 392/411 of the Indian Penal Code.

Two motorcycle borne criminals are said to have looted cash of Rs.80,000/-, two mobile phones and tab of the informant and the one mobile phone was recovered from the possession of the petitioner.

It is submitted by learned counsel for the petitioner that he is not named in the F.I.R. He has no concern with the occurrence. He has been falsely implicated in this case merely on the basis of confessional statement of co-accused Shyam Sah @

Patna High Court Cr.Misc. No.17578 of 2018 (03) dt.17-05-2018 - 2 - Shyam Kumar Sah. The said Shyam Kumar Sah happens to be mobile mechanic and he has taken the said mobile from the Shyam Kumar Sah without knowing it to be looted one. Barring the aforesaid mobile, no incriminating article has been recovered from his conscious physical possession. The petitioner has been languishing in custody since 07.12.2017. Similarly situated coaccused Shyam Sah @ Shyam Kumar Sah has been enlarged on bail by a co-ordinate bench of this court in Cr. Misc. No. 4328 of 2018 vide order dated 01.02.2018.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with K. Nagar (Srinagar) P.S. Case No.483 of 2017.
