2. The petitioner seeks regular bail in connection with Sessions Trial No. 74 of 2025 arising out of Daudnagar P.S. Case No. 590 of 2024 registered for the offence under Section(s) 108, 80(2), 61(1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the deceased-wife was married to the petitioner in the year 2021 and she died on 20.09.2024. The petitioner is accused of torturing and killing his wife due to non-fulfillment of the demand of dowry.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 20.09.2024 and claims a clean antecedent. He further submits that two children of the deceased

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. Sessions Judge-V, Aurangabad/concerned Court below in connection with Daudnagar P.S. Case No. 590 of 2024 subject to the conditions that:- (i). At the time of accepting the bail bonds of the petitioner, the Court below shall verify the statement of the petitioner i.e., two children of the deceased are living with the parents of the petitioner after her death. If the statement of the petitioner is found true then only his bail bonds shall be accepted;

(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner;

(iii). At the time of accepting the bail bonds of the petitioner, the Court below shall also verify the fact whether the
