The petitioner seeks regular bail in connection with Vibhutipur P.S. Case No. 279 of 2017 for the offences punishable under Section 302/34 of the Indian Penal Code. The allegation in the present case is regarding the accused person having indulged in witch-craft resulting in death of the son of the informant. The petitioner is stated to be the maternal aunt of the deceased.

The learned counsel for the petitioner submits that the records would bear it out that as far as the petitioner is concerned, at least is not having any complicity in the matter as well as she was not having any enmity with the deceased and moreover there is no question of engaging in witchcraft. The

Patna High Court Cr.Misc. No.24008 of 2018 (3) dt.03-07-2018 2/2 petitioner is stated to be having a clean antecedent and is languishing in custody since 30.11.2017.

Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Rosera, District- Samastipur in connection with Vibhutipur P.S. Case No. 279 of 2017.
