JUSTICE MOHIT KUMAR SHAH ORAL ORDER 26-06-2023 The learned counsel for the petitioner submits that the encroachment proceedings have already been initiated by the Circle Officer, Bhorey, vide Encroachment Case No.15 of 20222023, hence he be directed to dispose off the same, within a stipulated time frame.
Having regard to the limited prayer, made by the petitioner, in the present petitioner, I deem it fit and proper to dispose off the present writ petition, with a direction to the Circle Officer, Bhorey, to conclude the proceedings of the
Patna High Court CWJC No.17871 of 2022(2) dt.26-06-2023 2/2 aforesaid Encroachment Case No.15 of 2022-23, by passing the final order under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, after hearing the affected parties and in accordance with law, forthwith, without being prejudiced by the present order.
The writ petition stands disposed off on the aforesaid terms.
