The petitioner seeks bail in connection with Garkha P.S. Case No. 489 of 2017, registered for the offence punishable under Sections 397 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Further submission is that similarly situated co-accused person has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 73440 of 2018 vide order dated 09.01.2019. The petitioner is in custody since 07.04.2019.

Considering the facts and circumstances of the case

Patna High Court CR. MISC. No.65998 of 2019(2) dt.13-11-2019 2/2 and the submissions advanced on behalf of the parties, let the above-named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-2, Saran at Chapra in connection with Garkha P.S. Case No. 489 of 2017.
