Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code as well as Section 27 of the Arms Act. The FIR of the occurrence of murder is against unknown.
Submission is that name of the petitioner has surfaced in the confessional statement of co-accused Bijay Yadav @ Vijay Yadav who has already been allowed bail by a Coordinate Bench of this Court vide order dated 05.12.2017 passed in Cr. Misc. No. 48022 of 2017 (Annexure-2/1). Further submission is that similarly situated co-accused Niraj Yadav has
Patna High Court Cr.Misc. No.15412 of 2018 (3) dt.08-05-2018 2/2 also been allowed bail by a Coordinate Bench of this Court vide order dated 08.11.2017 passed in Cr. Misc. No. 42721 of 2017 (Annexure-2).
Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bettiah Town Police Station Case No. 337 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
