====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 19-03-2024 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 302, 120(B) of the Indian Penal Code.

3. Petitioner No. 1 is father-in-law and petitioner No. 2 is mother-in-law of the deceased.

4. As per the prosecution case, on 18.02.2023 at about 10:00 pm, informant received information that his daughter is serious and was being taken to Bhagalpur for better treatment. When the informant went there, he found that her daughter was

Patna High Court CR. MISC. No.82244 of 2023(3) dt.19-03-2024 2/3 dead. Informant suspects that all the F.I.R. named accused persons including these petitioners killed his daughter.

Learned counsel for the petitioners submits that informant is not an eye witness of the occurrence and being father-in-law and mother-in-law of the deceased, these petitioners have been made accused in this case only on suspicion. Petitioners are separate in mess and property and are not concerned with family affairs of the couple. From perusal of the F.I.R. it is apparent that prior information was given to the informant about illness of the deceased and during treatment at Bhagalpur, she died. Moreover, thrust of accusation is against husband of the deceased who is already in custody. Petitioners claim clean antecedent.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jamui in connection with Jhajha P. S. Case No. 201 of 2023,
