JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-12-2019 This is an application for grant of anticipatory bail in connection with Paraiya P. S. Case No. 206 of 2018, disclosing offence under Section 7 of the E.C. Act.

As per F.I.R. two Pick-up Vans carrying 244 bags of wheat was sent to the PDS shop of the petitioner, one was unloaded at the shop of the petitioner and another was at the godown Jhikatiya. Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case. It is not his duty to carry the wheat to his shop and apart from that he is ready to abide by any condition imposed upon him.

Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner,

No.71074 of 2019(3) dt.02-12-2019 2/2 above named, surrender before the court below within a period of three weeks from the date of receipt of certified copy of this order, on surrender, he will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M.-III, Gaya, in connection with Paraiya P. S. Case No. 206 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure with condition to cooperate in the investigation.
