Counsel for the petitioner submits that the instant case has been registered on the basis of complaint filed by mother of the deceased. The petitioner who is husband of the deceased had informed the informant and other family members just after the occurrence. The complaint case was filed on 19-03-2015 wherein the occurrence is said to have taken place between 12-04-2012 to 30-01-2015. The petitioner is in custody since 08-10-2016. Prayer for bail of this petitioner was earlier rejected by this court vide order dated 04-05-2017 passed in Cr. Misc. No. 13144 of 2017 with liberty to renew his prayer for bail after nine months, if, no substantive progress is made in the trial. The report, called for from the trial court has been

From the report, it appears that case of this petitioner has not even been committed to the court of Sessions. The case is running for receiving police paper and commitment of the case. Considering the aforesaid facts and circumstances, prayer for bail of the petitioner is allowed. The petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Siwan in Pachrukhi P.S. Case No. 128 of 2015 arising out of Complaint Case No. 618 of 2015 subject to condition that both the bailors should be close relative of the petitioner. The petitioner will not try to delay the trial or intimidate the prosecution witnesses. The petitioner will remain present physically in court on each and every date. The bail bond of the petitioner will be liable to be cancelled if he absents himself on two consecutive dates without showing any reasonable cause in the court below. (Sanjay Priya, J) A.K.V./- U T
