====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-07-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in connection with Didarganj P.S. Case No. 123 of 2024 registered under Sections 147, 148, 149, 341, 323, 337, 338, 307, 504, 506 of the Indian Penal Code and Sections 27, 25(1-B)a, 26 and 35 of the Arms Act.

3. Allegation against these petitioners is that these petitioners along with other co-accused persons assaulted informant by means of bricks and stones. It is further alleged that accused persons also fired upon informant, due to which he sustained injuries.

4. Learned counsel appearing on behalf of the petitioners submits that there is no specific allegation of commission of assault against them. They are only alleged to be

5. Learned A.P.P. appearing on behalf of the State opposed the bail application of the petitioners.

6. Considering the fact that injury caused by petitioner no. 1 has been found to be grievous in nature, prayer for anticipatory bail of the petitioner no. 1 is refused.

7. However, considering the fact that the injury caused by petitioner no. 2 has been found to be simple in nature and other circumstances of the case, let the above named petitioner no. 2 be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail-bonds of Rs. 10,000 (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Court of J.M.-1st Class, Patna City in connection with Didarganj P.S. Case No. 123 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
