Mr. Dharmveer, Advocate ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-04-2023 At the outset, learned counsel for the petitioners is permitted to make correction in the prayer portion of the bail petition.

Petition for pre-arrest bail of petitioner no. 1 is dismissed as withdrawn.

Heard learned counsel for the petitioner no.2, the informant and the State.

Petitioner no. 2 apprehends arrest in a case registered for the offence punishable under sections 147, 148, 149, 341, 347, 47, 307, 324, 323, 326, 120(B), 504 and 506 of the Indian Penal Code.

As per the prosecution, all the FIR named accused persons including these petitioners and 40-50 unknown persons

Patna High Court CR. MISC. No. 74898 of 2022(2) dt.06-04-2023 2/2 came and started abusing the informant, and on objection by this informant all accused persons abused and assaulted the informant and his brother causing them multiple injuries. Learned counsel for the petitioner no.2 submits that due to land dispute a free fight took place between the parties in which both sides sustained injuries. There is case and counter case. No specific overt act is alleged against the petitioners. Learned counsel for the State opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner no.2, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Motihari, East Champaran in Pakaridayal P.S. Case No.123 of 2022 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
