====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-03-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.

3. Informant alleges that his daughter was married in the year 2014 and out of the wedlock a child was born on 13.03.2023, it is next alleged that he received an information from Ranjit that his daughter is ill and later was informed that she died, accordingly, he reached the place of occurrence and the accused persons were found absconding and the dead body was also not found.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in the present case. Allegation is general and omnibus against this petitioner and no specific overt act has been alleged against him. It is further submitted that the marriage was nearly nine years old and in between these nine years no case ever came to be instituted either by the informant or the deceased. Petitioner is merely a neighbourer and not family members of in-laws of deceased. Husband of the deceased is in custody. Co-accused, with similar allegation, have already been allowed pre-arrest bail by a co-

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the submissions made by the learned counsel for the petitioner, let the petitioner above-named, in the event of arrest or surrender within eight weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in Rajapakar (Baranti OP) Police Station Case No. 91 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
