The petitioners, already in custody, seek bail in connection with Panchrukhi P.S.Case No. 285 of 2017 registered under Sections 413, 414, 467, 468, 471, 420 and 120B of the Indian penal Code.
Allegation in brief is that from the garage of petitioner no. 1, a Bolero vehicle was recovered of which chassis and engine numbers were found tampered. Whereas from petitioner no. 2, one mobile was recovered, which is said to be his personal one and it is stated that vehicle recovered from the garage of the petitioner no. 1 was brought by someone for repairing purposes but the name of the customer was not disclosed. Having considered the aforesaid facts and circumstances,
Patna High Court Cr.Misc. No.15661 of 2018(3) dt.14-05-2018 2/2 the prayer of bail of petitioner no. 1, namely, Ram Niwas Dubey, from whose possession stolen vehicle was recovered, is rejected and the trial court is directed to expedite the trial. Whereas petitioner no. 2 namely Mohan Kumar Sah @ Mohan Kumar, is directed to be released on bail, as only one mobile is said to have been recovered from his possession, upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan, in connection with Panchrukhi (Sarai) P.S. Case No. 285 of 2017.
