JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2019 Heard learned counsel appearing for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Kazimohammadpur P.S. Case no. 405 of 2017, registered for the offences punishable under Sections 66A/F of the I.T. Act, 2000. Accusation against the petitioners is that they uploaded an objectionable video on social site of facebook which created anger in a particular community. Submission on behalf of the petitioners is that no case under Section 66A/F of the I.T. Act, 2000 is made out against the petitioners and moreover, the informant has already compromised this case and the good sense between the informant and petitioners as well as people of the other community has already been restored and therefore in the aforesaid circumstances, prayer of anticipatory bail should be allowed.

No.66970 of 2019(2) dt.18-12-2019 2/2 Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners, above named, in the event of their arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Muzaffarpur East, in connection with Kazimohammadpur P.S. Case No. 405 of 2017, subject to conditions as laid down under Section 438(2) of the CrPC.
