Mr. Prem Kumar Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 19-06-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Bairiya P.S.Case No. 80 of 2017 registered under Sections 120B, 201 and 302, of the Indian penal Code. Allegation in brief is that informant's younger son was killed by the accused persons in connivance with the wife of the deceased who was having illicit relationship with co-accused Jhagru.

Submission is that there is no eye witness in this case and the petitioner is uncle of the deceased's wife and no uncle or father would indulge himself in the act of killing of his son-in-law supporting her illicit relationship with others even in the FIR, the relative of the informant giving information telephonically named only two persons, Jhagaru and Mustafa Mian, who had killed the deceased in

Having considered the aforesaid facts and circumstances, the petitioner, namely , Lochan Patel @ Lochan Raut is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Bettiah, West Champaran in connection with Bairiya P.S. Case No. 80 of 2017.
