2. A counter affidavit has been filed on behalf of the Board in which it is stated that the respondent-Board has no provision for providing grace marks.

3. Learned counsel for the petitioner is directed to file

Patna High Court CWJC No.16304 of 2023(3) dt.30-09-2024 2/2 representation before the respondent no. 8, the Director (Academic), Bihar School Examination Board, Patna within a period of one week from today, the respondent no. 8 shall dispose of the same after affording opportunity of personal hearing or through his counsel by passing a reasoned and a speaking order, in accordance with law, within a period of eight weeks, thereafter.

4. It is made clear that this Court has not expressed any opinion with regard to the merits of the claim of the petitioner.

5. The writ petition stands disposed of on the aforesaid terms.
