2. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

3. The petitioner is apprehending his arrest in connection with Bhorey P.S. Case No. 283/2023 dated 15.06.2023 registered for the offences punishable u/s 420, 468, 467 and 471 of the Indian Penal Code.

4. As per the prosecution case, under the scheme of Mukhya Mantri Ydyami Yojana, Industries Department, a loan of Rs. 10 lacs was sanctioned to the petitioner to purchase the machinery and to establish the project. It is further alleged that

Patna High Court CR. MISC. No.79887 of 2023(3) dt.29-01-2024 2/3 for each project D.P. R was provided to the petitioner for purchasing machinery to the extent of 25 % as deviation. It is alleged that to establish the aforesaid project, in three installments of Rs. 4 lacs on 21.07.2022, Rs. 4 lacs on 13.10.2022 and 2 lacs on 04.02.2023 were provided to the petitioner. During the course of inspection, vouchers were provided to Commercial Tax Department to verify and it was found that the vouchers were not original and the amount mentioned in the voucher was changed.

5. Learned counsel for the petitioner has submitted that the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is a lady. It is further submitted that after purchasing of machinery, the petitioner uploaded the vouchers on the portal of Ydyog Department of Bihar Government.

6. Learned A.P.P. for the State has vehemently opposed the prayer for anticipatory bail of the petitioner.

7. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.79887 of 2023(3) dt.29-01-2024 3/3 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Gopalganj in connection with Bhorey P.S. Case No. 283/2023, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
