Petitioner is an accused in a case registered for offence under Sections 328 and 302 of the Indian penal Code. It is submitted by learned counsel for the petitioner that he has been implicated in this case only due to earlier enmity and that there is no eye witness to the occurrence. The allegation against the petitioner is of having administered poison in the liquor which he consumed along with the brother of the informant (deceased) in the Barat party. The allegation of prior enmity has also been levelled in the F.I.R. Petitioner is having criminal antecedent.
Considering the gravity of the allegation, this Court
Patna High Court Cr.Misc. No.18322 of 2018 (3) dt.21-05-2018 2/2 is not inclined to grant bail to the petitioner for the present. The prayer for bail of the petitioner is rejected. (Madhuresh Prasad, J) N.H./- U T
