Petitioner, already in custody, seeks bail in connection with Siswan (Chainpur O.P.) PS Case No.40 of 2017, registered under Sections 147, 148, 149, 341, 323, 325, 307, 354, 302, 504 and 506 of the Indian Penal Code.

It is submitted that there is land dispute between both sides, there is case and counter case also and the petitioner also sustained injuries, however specific overt act attributed against the petitioner is of giving an axe blow over the deceased and several persons have assaulted him by lathi and danda but no corresponding injury of any incised wound is found rather injuries are in the form of bruise and one laceration in the forearm and the petitioner has no criminal antecedent.

No.18805 of 2018(3) dt.16-05-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Nand Kishore Mahto is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-X, Siwan in connection with Siswan (Chainpur O.P.)
