The petitioner seeks regular bail in connection with Sahebpur Kamal P.S. Case No. 188 of 2017 for the offences punishable under Sections 247, 148, 149, 341, 302, 120(B) of the Indian Penal Code and 27 of the Arms Act.

The allegation is regarding the accused persons including the petitioner herein having fired indiscriminately upon the uncle of the informant resulting in his death. The learned counsel for the petitioner has submitted that the petitioner was attending a trial, hence he could not have been present at the place of occurrence when the alleged occurrence had taken place. The petitioner is stated to be languishing in custody since 31.7.2017.

No.21723 of 2018 (5) dt.06-07-2018 2/2 Having regard to the facts and circumstances of the case as also the case diary which amply demonstrates that the petitioner is having a complicity in the alleged crime, I am not inclined to grant bail to the petitioner.
