JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Motihari Town P.S. Case No. 850 of 2017 for the offenses under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the case was registered against unknown and this petitioner, who was in custody in connection with other case, was remanded in the present case only on suspicion. The case was instituted on 30.11.2017, whereas the petitioner was in custody since 27.11.2017. The petitioner has remained in custody on remand in this case from 01.12.2017.

No.23153 of 2018(3) dt.17-05-2018 2/2 Considering the aforesaid facts and circumstances, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari in connection with Motihari Town P.S. Case No. 850 of 2017.

Bailors shall be the family members.
