Misc. applications have arisen out of the same P.S. case and as such they have been heard together and are being disposed of by passing this common order.
2. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
3. The petitioners seek bail in connection with
Patna High Court CR. MISC. No.72137 of 2025(2) dt.13-10-2025 2/3 Rampurhari P.S. Case No. 165/2025 registered for the offences punishable under Sections 30(a), 32(ii), 41(i) of the Bihar Prohibition and Excise Act.
4. As per the prosecution case, on 30.08.2025 the police got secret information that a black colour Scorpio loaded with liquor is going to Parmjivar village. When the police reached there, on seeing the police force, the said scorpio tried to flee but after chase, the police apprehended two persons and one person managed to flee. The persons who were apprehended, they disclosed names as Munna Sharma and Vikash Kumar (petitioners). On search of the said Scorpio, police recovered 320.580 liters of foreign liquor.
5. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in the present case. Learned counsel further submits that the petitioners are neither the owner nor the driver of the said seized Scorpio and no incriminating article was recovered from their conscious possession. Learned counsel further submits that petitioners have clean antecedent and they are in custody since 30.08.2025.
6. Learned APP for the State has opposed the prayer for regular bail of the petitioners.

7. Considering the facts and circumstances of the case, these applications for regular bail are allowed.
8. Accordingly, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge, Excise Court No.-II, Muzaffarpur in connection with Rampurhari P.S. Case No. 165 of 2025.
