JUSTICE MADHURESH PRASAD ORAL ORDER 21-05-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is an accused in a case registered for offence under Sections 406/420 of the Indian Penal Code and Section 138 of N.I. Act It is submitted by learned counsel for the petitioner that the allegations of extracting two installments of Rs.1,60,000/- against the petitioner on the pretext of getting a loan sanctioned is highly improbable as the alleged loan amount is only Rs.5,00,000/-. He submits that not even a cheat of paper has been produced to sustain the allegations and he has been implicated in this case in extraneous consideration. No witness has supported the case during the course of investigation. Though he is accused

Patna High Court Cr.Misc. No.18672 of 2018 (3) dt.21-05-2018 2/2 in another case bearing Fatehpur P.S. Case No.88 of 2017, in the said case, he is on bail. Petitioner is in custody since 8.1.2018. Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in Mufassil P.S. Case No.09 of 2018 on the following conditions : - One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner and The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
