Petitioner is an accused in a case registered for offence under section Learned counsel for the petitioner submits that the allegations pertain to the appointment process for the post of constable. It is alleged that the biometric attendance of the petitioner did not tally with the person who had appeared in the written test for appointment. It is submitted that the petitioner's counsel that many persons have been implicated in this case having similar allegation. He claims parity with co-accused Dilip Das who has been allowed bail by this Court vide order dated 30.4.2018, passed in Cr.Misc.No. 25728 of 2018. Prior to lodging of this case, petitioner is a man of clean antecedent. Petitioner is in
Patna High Court Cr.Misc. No.24741 of 2018 (3) dt.24-05-2018 2/2 custody in connection with this case since 22.2.2018. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt Sangeeta Rani, Additional Chief Judicial Magistrate cum Sub Judge XIV, Patna in Gardanibagh Police Station Case No. 45 of 2018 on the following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
(b) He/she will be well represented on each date and if he/she fails to do so on two consecutive dates, his/her bail will be liable to be cancelled.
