2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 341, 323, 324, 307, 504/34 of the Indian Penal Code and Section 37(c) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, allegation against the petitioner is of abusing and assaulting the informant due to which he sustained injuries. It is also alleged that the petitioner had consumed liquor at the time of occurrence.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is own nephew of the informant and there is admitted land dispute between them due to which this petitioner has

Patna High Court CR. MISC. No.85885 of 2023(2) dt.11-01-2024 2/2 falsely been implicated in this case. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and he is languishing in judicial custody since 9.7.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge him on bail. The above named petitioner is directed to be released on bail in connection with Singhiya P.S. Case No. 180 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise 1st Samastipur.
